Abid Ali Vs Civil Judge (Jr.Div) Lalganj Pratapgarh and 3 Others

By means of present petition under Article 227 of the Constitution of India, the petitioner has prayed for direction to the Civil Judge (Junior Division), Court No. 30, Pratapgarh to decide Original Suit No. 115 of 2020 - Ishratul Nishra & Others Vs. Shahnaz Bano, expeditiously.

Considering the fact that the suit proceedings are at a very initial stage where only notices have been issued to the defendants and the matter is pending for last four years. No such direction as prayed by the petitioner can be passed at this stage of suit proceedings.

However, liberty is granted to the petitioner to move suitable application before the trial Court detailing urgency for deciding the said suit expeditiously. In case such an application is filed within two weeks from today, the trial Court shall proceed to consider and decide the same within four weeks thereafter, and in case the trial Court finds that the suit proceedings deserve to be expedited, it shall pass necessary orders thereon and proceed expeditiously with the disposal of the suit.
