Heard learned counsel for the petitioner and Shri Tushar Verma, learned Additional Chief Standing Counsel for the State-respondents.

The petitioner's case is that since 10.08.1990, the petitioner was engaged as a Daily Wager on the post of Chaukidar in the office of Block Development Officer, Siddhaur, Barabanki, and he had worked for eighty days. Subsequently, his services were terminated orally, aggrieved by the same, the petitioner preferred a petition being, Writ Petition No. 6617 (S/S) of 1997, before this Court, and this Court vide order dated 15.09.2008 directed the respondent authorities to consider the petitioner's claim on the post of sweeper-cum-chaukidar.

Pursuant to the order of this Court dated 15.09.2008, the petitioner was appointed to the post of sweeper-cum-chaukidar. Thereafter, the petitioner moved a representation dated 28.12.2023 before respondent no. 2 for counting his services w.e.f. 10.08.1990, which is still pending undecided. Aggrieved by the same, the petitioner has preferred the instant writ petition.

In view of the foregoing discussions, the respondent no. 2- District Development Officer, District Barabanki, is directed to consider and decide the representation of the petitioner dated 28.12.2023 within a period of two months from the date of production of a certified copy of this order, in accordance with service conditions and law in this regard.

With the aforesaid observations, the writ petition is disposed of.
