Heard learned counsel for the petitioner. Notice on behalf of the respondent No.1 has been accepted by the office of the Chief Standing Counsel. Shri Suresh Kumar Upadhyay, learned counsel has appeared on behalf of the respondent No.2 on caveat.

By means of the instant petition, the petitioner seeks expeditious disposal of Revision No.713/2023 pending before the Board of Revenue.

The submission is that the matter is pending since 2002 as such an expedite order be passed.

Having considered the aforesaid submission and from the perusal of the material on record, it reflects that the revision was preferred which is engaging the attention of the Board of Revenue. An application was moved for earlier hearing and the same was allowed by the Board of Revenue. Thereafter the matter came up before the Board of Revenue on 08.05.2024 on which date after hearing the parties, the revision was admitted and the records were summoned and the revision has been fixed for hearing on 31.07.2024.

Having noticed the aforesaid, this Court is of the opinion that since the Board of Revenue has already allowed the application for early hearing and has fixed the revision for hearing on 31.07.2024. There does not appear any ground to entertain the petition for further expediting the proceedings.

In view of the aforesaid, the petition is misconceived and is accordingly dismissed at this stage.
