An afÏdavit of compliance filed by respondent no. 2 i.e. Shri Navratan (presently posted) Project Director, National Highways Authority Project, Executing Unit, Raebareli, alongwith an application for exemption of his personal appearance is taken on record.

Learned counsel for the respondent no. 2 has submitted that in compliance of the order/judgment dated 16.08.2023, the amount of compensation has been determined and it has been informed to the applicant by letter on 07/08-08.2024, the copy of which has been enclosed at Page-7 of the afÏdavit with a direction to the applicant to come over to the ofÏce for the purpose of execution of sale deed and it is the applicant who is not approaching the authorities for execution of the sale deed. The judgment and order of this court has been complied with and the present contempt application is liable to be dismissed and notices may be discharged.

On the other hand, learned counsel for the applicant has submitted that the rate which has been applied for the purpose of determination of compensation is not correct.

After arguing at some length, learned counsel for applicant has submitted that the order/judgment of this court has been complied with thus, the present contempt application has become infructuous and the same may be dismissed as infructuous with liberty to the applicant to approach the writ court by challenging the order dated 07/08-08-2024, as far as it relates to the rate applied by the respondent no. 2 for the purpose of determination of the compensation.

As prayed, the present contempt application is dismissed as infructuous.

Notices are hereby discharged and the personal appearance is dispensed with.

It is always open to the applicant to avail appropriate remedy as may be permissible under the law about the rate of the compensation.
