Heard learned counsel for the petitioner and Ms. Megha Pandey, learned counsel for the respondent no. 2.

With the consent of learned counsel for the parties, the instant writ petition is being finally decided.

Learned counsel for the petitioner after arguing at some length confines his prayer to his application for not taking the physical possession of the property in dispute filed by him on 08.06.2024 which is said to be pending before the learned Debt Recovery Tribunal, Lucknow (hereinafter referred to as "Tribunal") being decided by the learned Tribunal within a specified time. It is prayed that as the said application has been filed by him and is still pending for consideration as such, the bank be directed to not take physical possession of the property in dispute till such time the said application is decided.

Considering that the application filed by the petition is still pending for consideration before the learned Tribunal as such, the instant writ petition is disposed of with the direction to the learned Tribunal to decide the aforesaid application of the petitioner in accordance with law after hearing all the parties concerned provided there is no legal impediment within a week from today.

It would also be open for the petitioner to file an appropriate application for expeditious listing and hearing of the said application which, if filed, along with the certified copy of this order would also be considered by the learned Tribunal in accordance with law.
