Heard learned counsel for the applicant, learned AGA for the State and perused the record.

The accused-applicant seeks bail in Case Crime No.237 of 2022, under Section 302/ 34 IPC, Police Station- Gada Ganj, District- Raebareli, during trial.

It is argued that the co-accused against whom, all the allegations were levelled, was enlarged on bail vide order dated 9.4.2024 in Criminal Misc. Bail Application No.10030 of 2023.

Considering the fact that the applicant was also linked with the offence in question based upon the confessional statement and coupled with the fact that applicant has no criminal history and is in custody since 3.10.2022, the applicant is also enlarged on bail.

Thus, the bail application is allowed .

Let the applicant Ram Sumer @ Sumer be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
