Heard learned counsel for the applicants, learned AGA for the State and perused the record.

The present application under Section 482 Cr.P.C. has been filed to quash the charge sheet No. 1 dated 23.01.2019 submitted by the police before the concerned Court in criminal case no. 19230/2019 arising out of Case Crime No. 156 of 2018, under Sections 419, 420, 406 IPC, Police Station- Alambagh, District- Lucknow.

On the basis of the submissions made by the learned counsel for the parties, this Court vide order dated 18.05.2022, has referred the matter to the Mediation and Conciliation Centre of this Court, for amicable settlement between the parties.

In compliance of earlier order of this Court dated 18.05.2022, the Mediation and Conciliation Centre of this Court alongwith settlement agreement dated 17.10.2022 has submitted its report, which has been annexed as 'Annexure- E', wherein it has been mentioned that the parties were present and they have admitted that they have entered into an agreement voluntarily and their signatures have been verified by their respective counsels before the court.

With regard to the prayer sought including quashing of criminal proceedings on the basis of compromise, the learned counsel for the applicants has placed reliance on the judgments of the Apex Court in the case of Romgopal and others Vs. Learned Additional Government Advocate could not dispute the fact that the compromise has been entered into between the parties and now the opposite parties do not want to proceed further for quashing the charge sheet No. 1 dated 23.01.2019 submitted by the police before the concerned Court in criminal case no. 19230/2019 arising out of Case Crime No. 156 of 2018, under Sections 419, 420, 406 IPC, Police Station- Alambagh, District- Lucknow.

Considering the submissions advanced by learned counsel for the parties and perusing the report dated 17.10.2022 submitted by Mediation and Conciliation Centre of this Court as also taking note of the observations made by Hon'ble Apex Court in the judgments referred above, this Court is of the view that no purpose would be served in keeping the proceedings pending before the trial court and hence, the charge sheet No. 1 dated 23.01.2019 submitted by the police before the concerned Court in criminal case no. 19230/2019 arising out of Case Crime No. 156 of 2018, under Sections 419, 420, 406 IPC, Police Station- Alambagh, District- Lucknow are hereby quashed in terms of the compromise.

Accordingly, the present application U/S 482 Cr.P.C. is allowed .
