This is the second anticipatory bail application of the applicant.
Heard learned counsel for the applicant as well as learned A.G.A. for the State-respondent.
The present anticipatory bail application has been filed seeking bail in Case Crime No.40 of 2022, under Sections 417, 420, 406, 506, 467, 468, 471 IPC, P.S. Masauli, District Barabanki.
Learned counsel for the applicant submits that name of co-accused persons i.e. accused Nos.2 & 3 namely, Vaibhav Pratap Singh and Anubhav Singh both sons of Ram Govind Singh have been dropped due to their personal approach to the Investigating Officer. Applicant has been falsely implicated who is innocent employee of the company.
Learned A.G.A. has opposed the contention and has submitted that this cannot be a fresh ground. The Investigating Officer during investigation may not have found complicity of those persons hence, the applicant cannot derive any benefit for the same.
In view of the submissions advanced, perusal of the record, I do not find any ground to interfere and grant indulgence to the applicant in this second anticipatory bail application.
Accordingly, the anticipatory bail application is rejected .
