- Heard Shri R.U. Verma, learned counsel for the revisionist as well as Shri Rajesh Singh, learned Government Advocate appearing on behalf of the State-opposite party.
- Shri R.U. Verma, learned counsel for the revisionists states that he confines his prayer only to the extent that the revisionist be given the benefit of Section 4 of The Probation of Offenders Act, 1958 (hereinafter referred to as "Act, 1958").
- The contention is that the provisions of the Act, 1958, which though being a Central Act, has also been made applicable in the State of U.P. as per the judgment of the Hon'ble Supreme Court passed in the case of Mohd. Hashim Vs. State of U.P. and Others 2017 (2) SCC 198 wherein the Hon'ble Supreme Court has held that the benefit to be given to the first time offenders under the Act, 1958.
- It is contended that the revisionist may be extended the benefit of the Act, 1958.
