Heard learned counsel for the applicant.

Shri Amarjeet Singh Rakhra, learned counsel appearing for the respondents, while filing afÏdavit of compliance, informs that the order of the writ Court has been complied with and the admissible amount has been paid to the applicant. It is, thus, submitted that the application has lost its efÏcacy and may be dismissed.

Though, the aforesaid afÏdavit of compliance is taken on record, but it is evident from the memo of the contempt application that the deponent of the afÏdavit of compliance, namely, Mr. Omkar Prasad Gupta, Executive Engineer, Electricity-Secondary Works Division, Mirzapur is not arrayed as a party in the contempt application. However, in the said afÏdavit, it is mentioned that Mr. Omkar Prasad Gupta is duly authorized by the Managing Director, Purvanchal Vidyut Vitran Nigam Ltd.

Admittedly, in the contempt proceedings, authorization is not permissible. However, since this Court finds that the order of writ Court has already been complied with, the aforesaid afÏdavit of compliance is hereby accepted.

The application, accordingly, stands dismissed as infructuous.

However, respondent-authorities shall take care of that except the OfÏcer arrayed as a party in the contempt proceedings, no other person can be authorized to file any afÏdavit.
