Application has been filed seeking withdrawal of the SCC Revision.
In the affidavit filed in support thereof, it has been stated that SCC Revision has been filed challenging the order dated 12.03.2024 passed by the Judge Small Causes, Pratapgarh in SCC Suit No.02/2012 but now the parties have entered into an agreement out of Court settlement dated 06.05.2024 and damages have been waived off by the landlord/opposite party and the possession of the vacant premises has been handed over to the Landlord/opposite party also on 06.05.2024. A copy of the notarized agreement of settlement has also been brought on record.
In view of the averments made in the affidavit filed in support of the application, the same is allowed and the SCC Revision is dismissed as not pressed without any adverse affect upon the settlement arrived at between the parties.
