Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 and 2, Mr. Ran Vijai Singh, learned counsel for opposite party no.3 and Mr. Saurabh Singh, Advocate holding brief on behalf of Mr. Shailendra Singh Rajawat, learned counsel for opposite party no.4.

On 11.01.2024, the following order had been passed:-

"The grievance of the petitioner in the present petition is that even though she has been selected as Assistant Teacher by the U.P Basic Siksha Parishad but is not being issued an appointment letter because her name 'Yadav Nisha' has been recorded in the B.T.C Certificate and in the form filled-up by her which ostensibly does not tally with her Secondary School Certificate issued by the Maharashtra Education Board which records her name as 'Yadav Nisha Ramkumar'.

It is contended by the petitioner that 'Ramkumar' suffixed to her name 'Yadav Nisha' is her father's name and the practice of Maharashtra State Education Board is that the name of the father is suffixed to the name of the candidate as the certificate has no separate column for recording the name of the father and only separately records the name of the mother of the candidate.

Whether 'Yadav Nisha' and 'Yadav Nisha Ramkumar' are the same person can be verified by the Basic Siksha Parishad from the Maharashtra State Education Board.

Shri Ranvijay Singh, Advocate representing the U.P Basic Siksha Parishad prays for and is granted ten days time to seek instructions in the matter. Put up again as fresh on 24.1.2024."

Learned counsel appearing for opposite party no.3 submits that since there is the aforesaid difference, petitioner can always get her mark sheet corrected either from Maharashtra State Education Board or Uttar Pradesh State Education Board and in case of such correction, petitioner could be considered for issuance of appointment.

In view of aforesaid, it does transpire that there is difference in name as per the educational records issued from Maharashtra

State Education Board and those issued in Uttar Pradesh State Education Board as well as in the application form said to be submitted by petitioner.

Considering aforesaid facts, liberty is granted to petitioner to get the name corrected in the relevant educational certificates either from Maharashtra State Education Board or Uttar Pradesh State Education Board to bring in conformity with the application form.

With aforesaid observations and directions, the petition is finally disposed of .
