Heard Sri Mohd. Ateeq Khan, learned counsel for the petitioner.

In view of the proposed order notice to the respondents is dispensed with.

By means of the present petition under Article 227 of the Constitution the petitioner has sought a direction to opposite party No.1 i.e. Additional Civil Judge, Room No.21, (Senior Division), Lucknow for disposal of Original Suit No.287 of 67 (Nagar Panchayat Itaunja Vs. Bhanu Pratap Singh and others) within a stipulated time period.

4.It has been submitted that the said case is pending for last almost 57 years, as such, a case for interference is made out.

Accordingly, opposite party No.1 i.e. Additional Civil Judge, Room No.21, (Senior Division), Lucknow is directed to consider and decide Original Suit No.287 of 67 (Nagar Panchayat Itaunja Vs. Bhanu Pratap Singh and others) within a period of one year from the date a certified copy of this order is placed before him, in case there is no legal impediment, in accordance with law.

Counsel for the petitioner assures this Court that he will cooperate in the proceedings and appear on each date fixed in the matter by the Tribunal and shall not seek unnecessary adjournment. In case, he does not cooperate as above, the benefit of this order shall not be available to him.

With aforesaid direction, the petition stands disposed of.
