The present bail application under Section 438 Cr.PC. has been filed seeking anticipatory bail in case crime/FIR No. 15/2021, under Sections 147/148/149/452/504/506/356/307 I.P.C. and Sections 3(1)da, dha of S.C./S.T. Act, P.S. Para, District Lucknow.

Heard learned counsel for the applicant as well as learned AGA for the State.

Notices to respondent no. 2 are dispensed with in view of the proposed order.

Learned AGA has submitted that FIR is under S.C./S.T. Act coupled with the other offences under Indian Penal Code, hence, in view of the embargo under Section 18 and 18A of S.C./S.T. Act, the anticipatory bail application is not maintainable. It has been further submitted that there are five injured in this case and the applicant is absconding. It cannot be said to be a case of false implication.

Perused the record.

Perusal of the record shows that the applicant's complicity has been found in the CCTV footage and in the statement of the prosecution witnesses, coupled with the fact that the offences under S.C./S.T. Act is alleged to have been committed and considering the embargo under Section 18 and 18A of S.C./S.T.

Act also, I am not inclined to enlarge the applicant on anticipatory bail.

Accordingly, the anticipatory bail application is dismissed .
