1. Heard learned counsel for the applicant as well as learned A.G.A. and Sri Priyam Mishra, who has filed Vakalatnama on behalf of complainant and perused the record. The Vakalatnama is taken on record.

2 . The applicant seeks enlargement on bail in FIR No.360 of 2022, under Sections 147, 302, 201, 120B IPC, Police Station Manikpur, District Pratapgarh.

3 . It is argued by the Counsel for the applicant that on the same allegations two of the co-accused, namely, Shakeel Ahmad and Smt. Kusum Devi have been enlarged on bail by this Court vide order dated 12.01.2024 passed in Criminal Misc. Bail Application No.10316 of 2023 and Criminal Misc. Bail Application No.11362 of 2023 respectively.

4. Learned A.G.A. vehemently opposed the bail prayer.

Considering the allegations against the applicant being similar to the co-accused, who have been enlarged on bail coupled with the fact that the applicant is in custody since 15.04.2023 and the criminal antecedents has been duly explained in para 27 of the bail application, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed .

6. Let the applicant Waseem Ahmad @ Aman be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
