No notice need be issued to the respondents no. 6 to 8 taking into consideration the nature of order proposed to be passed.
Instant petition in the nature of Public Interest Litigation has been filed praying for a Mandamus commanding the respondents no. 2 to 4 to evict the encroachers from land Gata No. 2198 min./0.1010 hectare situated at Gram Sabha- Tribhuwan Nagar Grint Pagana, Tehsil & District- Gonda.
The Court had required the learned Standing counsel to seek instructions in the matter.
Today, the learned Standing counsel on the basis of instructions sent by Sub Divisional Magistrate, Gonda dated 02.03.2024 informs that four encroachers have been found encroaching the aforesaid land and proceedings under the Section 67 (1) of the Uttar Pradesh Revenue Code, 2006 (hereinafter referred to as "Code, 2006") have been initiated against them. He further states that an endevour would be made to decide the said proceedings within the time framed as prescribed under the Code, 2006 and the rules governing the same.
The aforesaid statement is recorded and the petition is consigned to record.
