Heard learned counsel for the petitioner. The instant petition has been preferred on behalf of the petitioner-Islam, however, the affidavit which has been filed, it is sworn by Mohd. Saleem who is shown in paragraph 1 to be the deponent and the petitioner, and it also states that he is the cousin brother and he has been authorized whereas there is no authorization or power of attorney permitting the said deponent to file the affidavit of the petitioner. The apparent discrepancy in paragraph 1 in respect of the person who is filing the affidavit cannot be appreciated.
Accordingly, the petition is dismissed as withdrawn with liberty to file afresh with appropriate parties and affidavit.
In case if the learned counsel for the petitioner moved an application for return of the certified copies, the office shall do the needful within a period of three days.
