Heard Sri Purshottam Chaurasia, learned counsel for petitioner as well as learned Standing Counsel for respondents.

By means of present writ petition, the petitioner has prayed for a writ of mandamus commanding oppot8ie party NO. 2 to consider and grant the fire arm license in pursuance of application dated 08.01.2018 b numbered as Application No. 349/2018.

It has been submitted by learned counsel for petitioner that petitioner had applied for an arms license and was issued a D.B.B.L. Gun 12 Bore License No. 6133/81. Subsequently, proceedings for cancellation of the arms license initiated against the petitioner and the said license was cancelled by order dated 03.04.1986 passed by District Magistrate. The petitioner being aggrieved by the order of cancellation had preferred an appeal before the Commissioner, Faizabad Division, Faizabd where initially an interim order was passed in his favour staying the order of cancellation but subsequently the appeal was finally dismissed by order dated 02.04.2007.

The petitioner in the aforesaid circumstances had approached this Court by filing a writ petition being Writ Petition No. 3410 (MS) of 2009 here this Court had granted liberty to the petitioner to move an application for grant of an arms license before the Licensing Authority and it was further provided that the same shall be considered within a period of three months.

The petitioner moved an application before the District Magistrate who duly considered the order of this Court dated 26.10.2017 and directed the petitioner to file a fresh application for grant of an arms license. It is in pursuance of the direction of this Court that the petitioner has preferred a fresh application

on 08.01.2018 which is pending consideration before the Licensing Authority i.e. opposite party no. 2. A prayer has been made for a direction for expeditious disposal of his application.

Learned Standing Counsel does not oppose the innocuous prayer made by learned counsel for petitioner.

Accordingly, the writ petition is disposed of with a direction to respondent No. 2 to consider and decide the application of the petitioner for grant of arms license expeditiously, say, within a period of two months from the date a certified copy of this order is produced before him in accordance with law.
