Heard learned counsel for petitioner, learned State Counsel for opposite party nos. 1 & 2 and Mr. Sudeep Seth learned Senior Counsel assisted by Mr. Atul Kumar Dwivedi, learned counsel for opposite party nos. 3 & 4.

Petition has been filed seeking a direction to the concerned authority to grant extension of two years in service to petitioner on the post of Professor in the subject of Hindi in the University concerned in accordance with the Government Order dated 04.06.2009. Further prayer for a direction for grant of pay increment in accordance with the aforesaid Government Order dated 04.06.2009 has also been sought.

It has been submitted that petitioner is covered by the Government order dated 04.06.2009 which specifically provides for such extension of service in such teaching staff who have received appreciation or rewards with regard to their services. It is submitted that petitioner's case is fully covered by the aforesaid Government order as would be evident from letter dated 13.10.2023 issued by the State Government to the University indicating such a fact and also directing the University to forward its recommendations while providing benefit of the Government Order dated 04.06.2009.

It is submitted that in pursuance thereof, the University has also taken appropriate steps and has submitted his recommendation dated 06.11.2023 to the State Government which is still pending consideration.

It is submitted that in pursuance thereof, directions may be required to be issued to the State Government to take a final decision thereupon.

Considering the innocuous prayer, without entering into merits of the case, the opposite party no. 1 i.e. Additional Chief

Secretary, Department for Empowerment of Persons with Disabilities, Government of U.P., Civil Secretariat, Lucknow or any other competent authority is directed to take a final decision with regard to recommendation dated 06.11.2023 submitted by the University, within a period of eight weeks' from the date a certified copy of this order is produced before the concerned authority. Petitioner shall annex a copy of the recommendation dated 06.11.2023 along with copy of this order.

With aforesaid observations and directions, the petition is finally disposed of.
