Heard Shri Dharam Trivedi, learned counsel for the applicant, Shri Rakesh Kumar Singh, learned AGA for the State and perused the record.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.723 of 2022, under Sections 419, 420, 467, 468, 471 IPC, Police Station-Kotwali Sadar, District- Lakhimpur Kheri.

The aforesaid case has been registered on the basis of an FIR lodged on 30.06.2022 against three named persons, including the applicant and some other unknown persons, alleging that the applicant took a Kisan Credit Card Loan from Canara Bank by falsely projecting himself to be one Mahal Singh, who had died long ago. The applicant withdrew Rs.7,70,0000/- in the name of Mahal Singh and he executed an agreement to sell the land in dispute on 19.5.2022.

It is recorded in the order dated 5.1.2024 that the petitioner is ready to deposit an amount of Rs.2,70,000/- in the bank, which amount had come to the applicant by the alleged offence.

Both the other named co-accused persons, Irshad and Mazloom have been granted bail by the Sessions Court and copies of the bail orders dated 10.08.2022 have been annexed as Annexure No.5 to the affidavit.

Another co-accused namely, Purshottam has been granted bail by means of an order dated 31.7.2023 passed by this court in Criminal Misc. Bail Application No.3958 of 2023.

Keeping in view the aforesaid facts and circumstances of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.

Accordingly, this bail application stands allowed .

Let the applicant - Pargat Singh be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:-

(i) As per the under taking given by the applicant before this Court, which is recorded in the order dated 5.1.2024, the applicant will deposit a sum of Rs.2,70,000/- with the lender bank within a period of two months from the date of his released from custody.

(ii) the applicant shall not tamper with the prosecution evidence;

¶18

(iii) the applicant shall not pressurize the prosecution witnesses;

¶19

(iv) the applicant shall appear on each and every date fixed by the trial court.
