उपरपो्ሹ आदकेश ककी विवैधतधा कपो चतुननौतती इस आधधार पर दती रयती हिवै कक ्ቚधारቕኍरण कके कविरु्ቍ लिरधायके रयके आरपोप असत्य हिह। मधाननतीय सविብኘच्च न्यधायधालिय कके कनणरय कमदतय जध ी स ं च ा ब ् यस ू रप बनध ो म आयरन जसस ा ं ह ि आकद , 2023 एससतसत ी ऑनल ी ध ि इन एससत ा ी 379 मम अविधधाररत हिवै कक धधारधा 482 दसं०्ቚ०ससं० कके असंतररत शक्ሹयोሱ कधा उपयपोर करतके हिहए न्यधायधालिय कपो लिघतु कविचधारण (कमनती रटधायलि) करनके ककी आविश्यकतधा नहिीሻ हिवै। इसमम अकभयपोजन / जधासंच एजमसती कपो आरपोपोሱ कपो सधाकबत करनके ककी आविश्यकतधा नहिीሻ हिवै। दसं०्ቚ०ससं० ककी धधारधा 482 कके असंतररत शक्ሹयोሱ कधा उपयपोर करतके समय न्यधायधालिय कके पधास बहिहत सतीकमत अजधकधार कके्ቔ हिवै और मधा्ቔ यहि कविचधार करनके ककी आविश्यकतधा हिवै कक "क्यधा आरपोपती कके कविरु्ቍ आरके बढ़नके कके जलिए कपोई पयधार्቎ सधामगती उपलिब्ध हिवै , जजसकके जलिए आरपोपती पर मतुकदमधा चलिधानके ककी आविश्यकतधा हिवै यधा नहिीሻ"।

यहि ्ቚधाररनधा-प्ቔ इस कनदरश कके सधार कनस्तधाररत ककयधा जधातधा हिवै कक यकद ्ቚधारቕኍरण कविचधारण न्यधायलिय कके समक उपसस्रत हिपोकर जमधानत पर ररहिधाई हिकेततु ्ቚधाररनधा प्ቔ दकेतधा हिवै तपो उसके मधाननतीय उच्चतम न्यधायधालिय दधारधा सतमदर कत ु मधर अस ा ं कतल ि बनधम सत ा ी . बत ी . आई .,
