The present writ petition has been preferred for issuing direction to the respondent no. 4, Executive Engineer Barabanki Division, Sharda Canal, Barabanki to decide the representation of the petitioner dated 27.01.2024 as per Rule 3(8) of the U.P Retirement Benefits Rules, 1961 and in compliance of the judgment of the Hon'ble Supreme Court dated 02.09.2019 in the case of Prem Singh versus State of U.P and others .

Learned Counsel for petitioner submitted that the respondents are not calculating the past services of the petitioner from the date of his initial appointment rendered by the petitioner as Work Charge Supervisor, due to which the petitioner is not getting the pension.

At this stage, learned counsel for petitioner has confined his prayer to the extent that a direction may be issued to respondent no. 4 to take a decision on representation of the petitioner dated 27.01.2024, within a stipulated time fame, as this Hon'ble Court may deem fit and proper.

Learned Standing Counsel has no objection to the aforesaid prayer made by learned counsel for the petitioner.

On the request of learned counsel for the petitioner and without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no. 4 i.e. Executive Engineer Barabanki Division, Sharda Canal, Barabanki to take a decision on the representation of the petitioner in accordance with law within a period of six weeks from the date of production/receipt of certified copy of this order Order Date :- 26.2.2024/DiVYa
