Heard V.K. Asthana, learned counsel for the petitioner and Sri Sushil Kumar Pandey, learned AGA.

In view of the proposed order, the notice to opposite party No.2 is hereby dispensed with.

The petitioner has filed this 482 Cr.P.C. petition praying for quashing of the criminal proceedings of Complaint Case No. 586 of 2017, u/s 406/420 IPC pending before Additional Civil Judge (J.D.), Court no. 5, District Kheri as well as summoning order dated 20.12.2012, in the interest of justice.

At the outset, learned counsel for the petitioner has prayed that the petitioner is ready to surrender before the learned court below and wants to move an application for bail, therefore, direction may be issued to the learned court below for expeditious disposal of bail application of the petitioner.

Learned Additional Government Advocate for the State has no objection to the aforesaid prayer.

Therefore, without entering into merits of the issue, the instant petition is disposed of , however, it is provided that in case the petitioner surrenders before the learned court below within a period of four weeks from today and moves application for bail relating to the aforesaid criminal case, the same shall be considered and disposed of in the light of dictum of Apex Court in re: Satender Kumar Antil vs. CBI and others in Special Leave to Appeal (Criminal) No. 5191 of 2021 with expedition without adjourning the case for any unnecessary reason.
