At the very outset, Sri Dharam Raj Mishra, learned counsel for the petitioner submits that he is not pressing the prayer no. 1.

The counsel for the opposite parties have no objection.

The innocuous prayer of the counsel for the petitioner is that the interest of justice would be sub-served, if this Hon'ble Court may be pleased to permit the petitioner to move a fresh representation and the District Basic Education Officer, Unnao may be directed to consider and decide the same while ventilating the claim of the petitioner within a stipulated period of time as may be fixed by this Court.

The counsel for the opposite parties have no objection.

In view of the above and without entering into the merits of the case, the petitioner is given liberty to move a fresh representation, while raising his claims before the opposite party no. 3, i.e., District Basic Education Officer, Unnao within a period of 15 days and if such a representation is moved, the opposite party no. 3 is directed to consider and decide the same within further period of eight weeks, in accordance with law, with speaking and reasoned order.

With the aforesaid observations, the instant petition is disposed off .
