Heard learned counsel for the petitioners. Notice on behalf of State-respondents has been accepted by the office of the learned Standing Counsel. Sri Nagendra Pratap Singh, learned counsel has put in appearance on caveat and has raised a preliminary objection that the petitioner is assailing an order passed in revision wherein he was not a party.
He has further submitted that the order impugned was already challenged before the Board of Revenue and that fact has also not been stated in the petition.
Sri Nagendra, learned counsel further submits that his client Sri Sarvadanand has not been impleaded in the instant petition.
It has further been submitted that in view of the aforesaid, the instant petition is not maintainable.
Sri Prabhat Kumar, learned counsel for the petitioners submits that at the outset he requires the indulgence of the Court for not pressing the instant petition, however, he seeks liberty to place on record the complete parties as well as the pleadings for effectual adjudication of the controversy.
In view of the aforesaid, the petition is dismissed as not pressed, however, liberty is granted to the petitioner to file afresh petition with proper parties and pleadings whenever such fresh petition is filed and a copy of the same shall be served on Sri Nagendra Pratap Singh, learned counsel who appeared on caveat.
With the aforesaid, the petition is dismissed as not pressed with the liberty , as prayed for.
