Heard learned counsel for petitioners, learned State counsel for opposite parties no.1 & 2 and Mr. Ravi Singh, learned counsel for opposite party no.3.

Petition under Article 226 of the Constitution of India has been filed seeking following relief:-

"i. To issue a writ, order or direction in the nature of MANDAMUS commanding the opposite parties specially the opposite party no.2 and 3 to extend the approval/afÏliation to the petitioners' institution regarding the D.Pharm course for the academic session 2024-2025 as admittedly no students have been allocated to the petitioner's institution by the Board of technical institution, Uttar Pradesh due to delayed process.

ii. To issue a writ, order or direction in the nature of mandamus commanding the opposite parties Nos.2 and 3 to extend the benefit of order dated 23/09/2024 passed by this Hon'ble Supreme Court of India in Misc. Application No.18950/2024 in Civil Appeal No.9048/2012 (Parswanath Charitable Trust and another V/s All India Council of Teachers and others) in the interest of justice as the matter of the petitioners' institutions is fully covered by the order dated 23/09/2024 passed by the Hon'ble Supreme Court of India, in the interest of justice.

iii. Issue such other appropriate writ, direction or order which this Hon'ble Court may deem just and proper in the circumstances of the case."

In view of innocuous prayer being, without entering into merits of the case, opposite party no.3 i.e Manager, SDBM Pharmacy College, Madhpatti, District Deoria is directed to take a final decision in accordance with law with regard to grievance of petitioner in the light of judgment

rendered by Hon'ble the Supreme Court in case applicable expeditiously, preferably within a period of three weeks from the date a certified copy of this order is produced before the said authority.

In view of aforesaid direction, the petition stands disposed of .
