The learned counsel for the applicant has stated that if the medical condition of the present applicant does not improve, he will have to re-admit in any super specialty hospital. For that his bail application may be considered sympathetically. The present applicant is in jail since 30.09.2024, in case crime no. 24 of 2021, under Sections 147, 148, 302/34 of IPC at Police Station Kotwali Nagar District Raebareli and has been falsely implicated in the present case inasmuch as he was initially named in the First Information Report but after through investigation, the final report was filed in his favour but he has been summoned under Section 319 of CrPC. Even if the allegation against the present applicant are taken on its face value, he has not committed any offence of 302 of IPC but it has been alleged that he was present at the place in question and he was exhorting for doing such offence. The present applicant is having no prior criminal history of any kind, whatsoever. The learned counsel has further submitted that if the applicant is released on bail, he shall shall cooperate in the trial proceedings and shall not misuse the liberty of bail. Further, the applicant shall abide by all terms and conditions of the bail order, the applicant may be enlarged on bail.
