Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite party No.1 and Mr. Ashutosh Verma Advocate holding brief on behalf of Mr. Alok Saran learned counsel for opposite parties 2 and 3.
Petition has been filed seeking a direction to the competent authority to consider petitioner's candidature for compassionate appointment in place of his brother late Virendra Kumar who is said to have passed away on 11th April, 2023. It is submitted that petitioner was fully dependant on his late brother although he is not sole heir.
Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to move a fresh representation before opposite party No.2 i.e. Executive Engineer, Electricity Distribution Division (CESS-III) LESA, Madhyanchal Vidyut Vitran Nigam Limited, Lucknow. In case such a representation is filed, the same shall be decided within period of six weeks from the date a certified copy of this order is produced before the said authority after affording opportunity of hearing to all heirs of deceased.
With the aforesaid directions, the writ petition stands disposed of.
