Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite parties 1 and 2 and Mr. Abhinav Singh learned counsel for opposite parties 3 and 4.

Petition has been filed challenging order dated 5th August, 2023 whereby gratuity claimed by petitioner has been rejected on the ground that her husband had expired after attaining the age of 60 years.

It has been submitted that in fact the rejection order is based on the death certificate dated 20th December, 2023 in which the date of death has been wrongly incorporated.

Learned counsel for opposite parties 3 and 4 submits that petitioner's claim can not be considered for gratuity until and unless the death certificate is corrected by the appropriate authority.

In view of such submissions, without interfering with the order dated 5th August, 2023, liberty is granted to petitioner to approach the authorities again after correction, if any, in the death certificate of the deceased late Mohd. Afaq Khan.

In view of aforesaid, the writ petition stands disposed of.
