Learned counsel for the petitioner submits that despite the order of status-quo being in full knowledge of the private respondents, who were defendants in the said proceedings, boundary wall has been illegally constructed in violation of the interim order dated 13.03.2020. He further submits that the Sub-Divisional Officer, Handia, District Prayagraj, thereafter, passed an order dated 06.05.2022 in which it is mentioned that spot inspection was carried out and it was found that constructions of boundary wall had been illegally raised in violation of the interim order of statusquo passed on 13.03.2020. Accordingly, a direction was issued to the defendants (private respondents herein) to remove their constructions within a period of seven days, failing which the same shall be got demolished by police force as well as Tehsildar, Handia. Learned counsel for the petitioner submits the despite the order dated 06.05.2022, which was not assailed by the private respondents nor has the same been vacated/ modified/ set aside or varied in any proceedings thereafter, the said order is not being implemented on the spot and the constructions raised by the private respondents in violation of the interim order of status-quo are existing. He submits that the petitioner has moved applications dated 14.12.2022 and 21.12.2022 requesting compliance of the order dated 06.05.2022, however no heed is being paid to the same. Therefore, this writ petition has been filed seeking a direction upon the the Sub-Divisional Officer, Handia, Prayagraj (respondent no.2) to ensure compliance of the order dated 06.05.2022.
