In pith and substance, the recovery notice dated 03.07.2017 issued by the respondent No. 5 i.e. the District Manager, Uttar Pradesh Co-operative Federation Ltd. Gorakhpur (Annexure No. 1 to the writ petition) is being questioned.
Learned counsel for the petitioners submits that bunch of the matters has already been decided by the Co-ordinate Bench of this Court and submitted that the present matter is squarely covered. He further submits that similar indulgence may also be extended in favour of the petitioners.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending and with the consent of the parties, the writ petition is disposed of in terms of Maa Bhawani Rice Mill and another Vs. State of U.P. and others, 2014 (4) AWC 4286 and in the light of Writ C No. 37498 of 2013 (M/s Annapurna Rice Mill Dehri Vs. State of U.P. and 3 others) decided on 28.11.2022.
