Learned counsel for the petitioner submits that only ground for cancellation of armed license no.6506/Part-2/85 Rifle No.AB-82/500 is that two criminal case has been registered against the petitioner namely proceedings under Section 107/116 Cr.P.C. and Case Crime No.285/09 under Section 147, 148, 149, 323, 307, 506 I.P.C. P.S. Mainather District Moradabad. It is argued by learned counsel for the petitioner that the proceedings under Section 107/116 Cr.P.C. had automatically ended after expiry six months from the date of initiation and insofar as the Case Crime No.285/09 under Section 147, 148, 149, 323, 307, 506 I.P.C. is concerned, the petitioner had been acquitted by the trial Court in the aforesaid case crime vide its order dated 18.05.2013, copy of the aforesaid judgement is appended as Anneure No.5 to the petition. He further submits that there is no material on record to show that armed license granted to the petitioner has been misused or there is any danger to public safety except the allegations that criminal cases are pending against him. It is further argued that license can only be cancelled only to reasons assigned to Section (3) of Section 17 of the Arms Act, 1959. Learned counsel for the petitioner argued that his case is squarely cover with the judgement delivered by this Court on 14.11.2022 in the case of Suresh Singh Vs. State of U.P. and others (Writ C No.19871 of 2021) .
