Heard Sri Abhai Mishra, Advocate holding brief of Sri Kshitij Shailendra, learned counsel for the petitioner and learned Standing Counsel for the State respondents.

Chanakyapuri Cooperative Housing Society Limited is before this Court with request to issue direction to the second respondent i.e. Competent Authority, Urban Land (Ceiling and Regulation), Moradabad to decide the petitioner's recall application dated 18.12.2015 filed in Case No.1343/6560 (Chanakyapuri Co Operative Housing Society Limited vs. State of UP and ors) within some stipulated time.

Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.

No useful purpose would be served in keeping the writ petition pending consideration.

In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to decide the aforesaid recall application, if it is still pending and the same is admissible in law, expeditiously, without granting unnecessary adjournments to either of the parties but certainly after giving opportunity of hearing to all the stake holders in the matter.
