It appears from the record that the mother of the petitioner namely late Savitri Devi was recorded tenure holder of Gata No.162 area 0.0912 hec. situated at village Satueiya Khas Tesil Meerganj, District Bareilly. The said land was acquired by National Highways Authority of India (hereinafter referred as NHAI) under National Highways Act, 1956 (in short, the Act) for widening of the National Highway No.24 from 212.90 kms to 236.40 kms (Moradabad-Bareilly Section). After completion of necessary formalities the Special Land Acquisition Officer/Competent Authority had passed an award on 22.11.2011. The mother of the petitioner was not satisfied with the awarded amount. Consequently, she had preferred an application for referring the matter to the Arbitrator under Section 3G (5) of the Act and the same was registered as Arbitration Case No.60/2013 (Smt. Savitri Devi vs. Competent Authority and another). After hearing the parties and perusal of the record and evidence the Arbitrator had passed an award under Section 3G (5) of the Act on 30.8.2014. Meanwhile, the mother of the petitioner died on 12.1.2016. Being aggrieved by the arbitral award dated 30.8.2014 the NHAI had filed an application under Section 34 of the Act before the District Judge, Bareilly for setting aside the award, wherein the petitioner had submitted his reply/objection. Thereafter, the application was dismissed for want of prosecution on 06.5.2022.
