1. Heard learned counsel for the parties.

By means of the instant writ petition, the petitioner has prayed for a writ of mandamus directing the respondents not to dispossess the petitioner over the land of Khata No. 96, Gata No. 55/0.0510 hectare, Gata No. 56/0.2910 hectare, Gata No. 57/0.3040 hectare, Gata No. 58/0.1900 hectare, Gata No. 59/0.1390 hectare, Gata No. 60/0.3290 hectare, Gata No. 61/0.2280 hectare, Gata No. 62/0.3920 hectare, Gata No. 64/0.2530 hectare, Gata No. 65/0.5560 hectare, Gata No. 66/0.2150 hectare, Gata No. 171/0.4930 hectare, total measuring area 3.4410 out of 1/2 (half part) measuring area 1.7205 situated at village Sherpur (Hastinapur), Tehsil Mawana, District Meerut which was purchased by its original owner Smt. Shakuntla W/O Shobveer Singh R/O Village Mubarikpur, Pargana Sherpur (Hastinapur) and Tehsil - Mawana District Meerut by registered sale deed on 09.09.2022.

Since the dispute between the petitioner and the respondent no.4/Forest Officials is with regard to demarcation of bhumidhari land/forest land, learned Standing Counsel submits that the revenue authorities shall get the respective plots demarcated on the spot.

In view thereof, the writ petition is disposed of directing the Sub-Divisional Magistrate, Tehsil- Mawana, District- Meerut/respondent no.3 to demarcate the plots on the spot in the presence of the petitioner, as well as, the forest department. Entire exercise to be carried out expeditiously within a period of six weeks from the date of filing certified copy of this order along with the extracts of all the revenue records.

It is clarified that the Court has not adverted into the merits of the case.

The eviction of the petitioner shall abide by the demarcation on the spot by the Sub-Divisional Magistrate, Tehsil- Mawana, District- Meerut/respondent no.3.
