Learned counsel for the petitioner is permitted to implead the State of U.P. as well as Additional Commissioner (Administration), Pindara, Varanasi as respondent nos.7 & 8 in the array of the parties during course of the day.

Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Mr. Bhupendra Kumar Tripathi, learned counsel for respondent-Gaon Sabha.

The instant petition has been filed for mandamus directing the respondent no.8 i.e. Additional Commissioner (Administration), Pindara, Varanasi to decide the Case No.C202114000000755 of 2021 (Phulwasi Devi Vs. Dinesh Singh and Others), under Section 219 of U.P. Land Revenue Act within stipulated period.

Learned counsel for the petitioner submitted that the revision filed by the petitioner, under Section 219 of U.P. Land Revenue Act is pending before respondent no.8 since 2021. He further submitted that the order sheet of the case has been annexed as Annexure No.2 to the petition in order to demonstrate that the case is not proceeding expeditiously.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.8 i.e. Additional Commissioner (Administration), Pindara, Varanasi is directed to decide the aforementioned revision on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him.

Accordingly, the writ petition is finally disposed of.
