Learned counsel for the petitioner has fairly stated today that the possession of the mortgaged property has been taken over on 11.09.2023, pursuant to the order dated 08.06.2023.
Learned Standing Counsel states that the writ petition be not taken cognizance of in pursuance of the judgment of the Supreme Court passed in Satyawati Tandon and others vs. Union of India 2010 (8) SCC 110 .
After having heard the learned counsel for the parties and upon going through the judgments cited, we are of the considered view that no interference is called for in this petition, in view of the fact that the possession of subject property has already been taken over by the respondent no. 2 on 11.09.2023.
In view of the above, the writ petition has now become infructuous and is accordingly, disposed of .
