Heard Sri Rajdhar, learned counsel for petitioner and learned Standing Counsel for the State-respondents.

Present writ petition has been filed seeking following reliefs:

"I. Issue a writ, order or direction in the nature of certiorari quashing the impugned ex-parte order passed by Tehsildar Bhadohi in Case no. 477 of 2012-13 under Section 122-B of U.P.Z.A and 1950 report Lekhpal Vs. Pyare Lal on dated 27.2.2018 village Bhori, Pargana Bhadohi, Tehsil Bhadohi, District-Bhadohi (Sant Ravidas Nagar) (Annexure-4 to the writ petition).

II. Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to decide the restoration application filed by petitioner on dated 15.11.2022."

Learned counsel for petitioner submits that grievance of petitioner would sufficiently be met in case, if restoration application dated 15.11.2022 may be considered and decided in a time bound manner by the respondent no. 2.

Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.

Be that as it may, without entering into the merits of the case as well as if there is no other legal impediment available, the respondent no.2 is hereby directed to consider and decide restoration application dated 15.11.2022 preferred by petitioner, as expeditiously as possible, preferably within a period of nine months from the date a certified copy of this order produced before him, after affording proper opportunity of hearing to all the parties.

With the aforesaid directions, the writ petition is disposed of.
