Heard learned counsel for the petitioners, learned Standing Counsel for the State-respondents and perused the record.

The petitioners have preferred this writ petition for a direction to the respondents not to interfere in their peaceful married life and also for protection of their lives and liberty.

Learned counsel for the petitioners submitted that petitioners are Muslim by religion, they have solemnized their marriage/nikah, driven by love affairs, out of their own free will and choice on 15.07.2023, copy of the nikahnama is annexed as annexure-3 to the writ petition. They have also applied online registration of their marriage. They have filed joint affidavit in support of their pleadings in writ petition.

Date of birth of petitioner no.1 is mentioned as 05.11.1994 in her High School Examination Certificate-cum-Mark Sheet and that of petitioner no.2 is mentioned as 18.09.1994 in his High School Examination Certificate-cum-Mark Sheet, thus both have attained the age of majority on the date of marriage. They started living as husband and wife peacefully but their marriage and relationship is strongly opposed by father and other family members of petitioner no.1. They are threatening the petitioners constantly of dire consequences.

It is informed by the learned Standing Counsel that petitioners have not filed any application before the SSP concerned.

According to this Court, first petitioners have to approach the concerned SSP/SP and if no proper steps are taken only then a petition can be entertained.

Learned counsel for the petitioners states that a liberty may be given to the petitioners that in case any such condition arises, the petitioners may approach to the office of the concerned SSP/SP or to take legal recourse as provided under law.

It is directed that if such an application is moved by the petitioners, the SSP/SP concerned shall take necessary steps in accordance with law within the reasonable time.

In view of above, this writ petition is disposed of.
