Heard Shri Gulab Chandra Tiwari, learned counsel for the petitioner and Shri Jitendra Narain Rai, learned Standing Counsel for the State-respondents No. 1, 2 and 3.
This Court vide order dated 22.9.2023 granted time to learned Additional Chief Standing Counsel to seek instructions in the matter.
Shri Jitendra Narain Rai submits that he has received written instructions dated 16.10.2023 from the Sub Divisional Officer, Badlapur, district Jaunpur.
On the basis of the aforesaid written instructions, he submits that the demarcation of the plot in question has already been made by the Revenue Authorities in the presence of the petitioner.
Learned counsel appearing on behalf of the petitioner does not dispute the aforesaid statement made by the learned Additional Chief Standing Counsel and submits that as per his instructions grievances of the petitioner have been ventilated. He further submits that since the dispute in respect of the demarcation has already been settled, therefore, at this stage he does not want to press this writ petition further. He prays for and is allowed to withdraw the said writ petition.
In view of the aforesaid statement made by the learned counsel for the parties and the prayer as made by the learned counsel for the petitioner, the writ petition is dismissed as withdrawn.
