This petition has been filed challenging the e-Auction proceedings initiated by the respondent-Bank on 26.06.2023.
It appears that during the pendency of the petition, attempts were made to amicably resolve the issue by availing of one time settlement of outstanding dues. Supplementary affidavit has been filed acknowledging the receipt of such request and a communication has also been made by the Bank on 05.08.2023, requiring the petitioner to deposit the amount in terms of such decision.
From the materials placed on record, it appears that petitioner is already pursuing his grievance before the Bank and such consideration is at an advanced stage. In that view of the matter, no further adjudication is required in the petition, as of now. Leaving it open to the petitioner to pursue the claim before the Bank, this petition is consigned to records, at this stage.
