The petition has been filed challenging the demand notice dated 05.09.2022 and the order of provisional assessment dated 18.10.2022 and for a mandamus directing the respondents to give opportunity of hearing to the petitioner and for a further direction to restore the electricity connection.

Sri Baleshwar Chaturvedi, learned counsel appearing on behalf of respondents 2 to 4, on instruction, states that the impugned proceedings as well as demand notice has been withdrawn and that the respondents will initiate fresh proceedings.

Learned counsel for the petitioner submits that since the impugned proceedings have been withdrawn, therefore, the respondents be directed to restore the electric supply.

We file sufficient force in the said submission.

Accordingly, the petition is disposed of with liberty to the respondents to proceed afesh in accordance with law and in the meantime, restore the electricity connection, without prejudice to their rights to take appropriate action as may be warranted under law after the final assessment order is passed.
