Heard learned counsel for the petitioner and Sri S.C.Upadhyay, learned Standing Counsel for the Staterespondent.

In view of the order, which is proposed to be passed today, notices need not go to the private respondents.

In pith and substance, petitioner is before this Court with a request commanding the respondent authorities to decide the application dated 3.5.2023 to stop interference of the private respondents in the construction of house of petitioner over Gata No. 638, village Thanair, tehsil Atarra, district Banda, which is recorded in the name of the petitioner as Bhoomidhar.

Learned Standing Counsel fairly states that in case the aforesaid application is still pending and has not been disposed of, the same will be considered and decided expeditiously.

In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the competent authority to look into the grievance of the petitioner and decide the aforesaid application strictly in accordance with law after giving opportunity of hearing to the private respondent nos. 5 to 7, as expeditiously as possible and preferably within a period of six weeks from the date of production of a certified copy of this order before him.
