Heard Mr. Ranjeet Yadav, Advocate, learned counsel for the Petitioner, Sri K.P. Verma, learned counsel for the Respondent No. 3 and learned Standing Counsel for Respondents No. 1 and 2.
In view of the order proposed, notices to private Respondents No. 4 to 7 are dispensed with.
Learned counsel for the petitioner has submitted that petitioner has filed a case under Section 144 of U.P. Revenue Code, 2006 on 04.06.2021 and the said case has been numbered as Case No. 02602 of 2021, Computer Case No. T202116670502602 (Mirza Sayeed Beg Vs. State of U.P. and Others). Respondents No. 4 and 5 have also filed their written statements in the aforesaid case on 28.01.2023.
Learned Counsel for the Petitioner has further submitted that the aforementioned case was filed on 04.06.2021 and since then the matter is pending before Respondent No. 2.
Learned counsel for the petitioner has vehemently argued that the case filed by the petitioner is being lingered on since 04.06.2021 on one pretext or another and due to pendency of the aforesaid case, lots of difficulties are arising on the spot.
I have considered the submissions advanced by the learned counsel for the Petitioner. I find that the case under Section 144 of U.P. Revenue Code, 2006 was instituted by the Petitioner on 04.06.2021 and is pending before the Respondent No. 2 since then. It is well settled legal proposition that every litigant has a right to get his case decided expeditiously.
In view of the aforesaid reasons, particularly keeping in view that the case filed under Section 144 of U.P. Revenue Code, 2006 is pending since 04.06.2021, this Writ Petition is finally disposed of with a direction to Respondent No. 2 to decide Case No. 02602 of
2021, Computer Case No. T202116670502602 (Mirza Sayeed Beg Vs. State of U.P. and Others) expeditiously, preferably within a period of eight months from the date of presentation of certified copy of this order.
Needless to say that Respondent No. 2, while deciding the aforesaid case, will not grant unnecessary adjournment to any of the parties.
