Heard learned counsel for petitioner and learned Standing Counsel appearing on behalf of State-respondents.
The petitioner, a member of Gram Sabha is challenging constitution of Samitis under the provisions of Uttar Pradesh Panchayat Raj Act, 1947.
Petitioner has approached earlier this Court by way of filing a writ petition which was disposed of with liberty to petitioner to approach District Collector to ventilate his grievance.
The Collector by impugned order dated 06.01.2022 considered the grievance of petitioner and after looking into material available, no irregularity was found in the constitution of Samitis, and has noted that in one of the Samiti, petitioner is also a member. The petitioner has not come up with any material to dispute the factual aspect mentioned in impugned order.
Therefore, this writ petition has no basis, accordingly, dismissed.
Petitioner is advised to utilize his energy in positive manner for welfare of Gram Sabha and village concerned whose residents have elected him as a member of Gram Sabha.
