Heard the counsel for the petitioner.
A copy of the writ petition has been served upon Sri Rahul Sahai the counsel for the respondent.
The present petition has been filed challenging the order dated 24.12.2022 as well as the order passed against the petitioner rejecting the recall application on the ground that the petitioner did not submit any valid certificate to demonstrate that he was unwell. The application of the petitioner came to be dismissed on 23.11.2022.
I do not see any reason why the application has been dismissed, more so in view of the intent of the statute to promote the settlement, as such, the orders dated 24.12.2022 and 23.11.2022 are set aside. The matter is restored and the Permanent Lok Adalat is directed to pass orders in accordance with the mandate of the Act after hearing the parties in accordance with law.
The writ petiton stands disposed off .
