Hon'ble Pankaj Bhatia,J.
1 .An illness slip has been sent by Sri Amar Nath Dubey, learned Counsel for the petitioner, however, as the matter is very old one, I do not propose to adjourn the matter.
2 . The writ petition was filed against an order passed in a miscellaneous appeal, whereby an injunction was granted in favour of the opposite parties.
3 . When the matter was entertained, this Court had passed an interim order on 25.11.2010 restraining the demolition f the construction.
4 . Considering the fact that the appellate order is of the year 2010, I do not propose to keep the matter pending, the present writ petition is disposed off directing the court below to decide Suit No.199 of 1997, if already not decided, in accordance with law.
5 . The Registry is directed to communicate this order to the Court hearing the Suit No.199 of 1997.
