Heard Sri Ved Prakash Pandey, learned counsel for the petitioner and learned Standing Counsel.

Petitioner, who is presently working on the post of Seenchpal in the Irrigation Department seeks promotion from the post of Seenchpal to Seench Paryavekshak in the reserved category for physically challenged persons.

He submits that 4% posts are reserved out of the total sanctioned posts for physically challenged persons and therefore, if the figure comes out to be 0.64, then it should be taken as one by rounding it off as it comes to more than the half and he being the only physically challenged person in the feeding cadre, he could be given promotion.

It is on this above premise that he has challenged the order passed by the authorities dated 05.04.2019 and 06.03.2019, whereby, his claim has been rejected on the ground that if all the category of physically challenged persons is taken then petitioner would fall only in the category reserved for 1% of the total vacancies and which would come to 0.016 as the sub category for physically challenged persons. It has also come to be recorded in the order that total percentage of vacancies that will fall in the category of physically challenged persons would be 0.64 as the total number of vacancies are 21 in which 75% posts are reserved for promotion quota. The promotion quota posts therefore, would be 16 only.

Learned Standing Counsel has argued that even if the 4% posts are taken to be reserved for physically challenged persons in the light of Government Order dated 28.08.2015, the rounding of principle has been directed to be not applicable. It is only when the posts come to a round figure one then such one post will come in the reserved category and so on.

Meeting the above argument in the rejoinder affidavit, learned counsel for the petitioner submitted that in view of the Government Order dated 03.01.2008 the quota prescribed for physically challenged persons could be increased by 5 times

Having heard learned counsel for the respective parties and their arguments raised across the bar and having perused the records, I find that the total number of sanctioned posts of Seench Paryavekshak are 21 in number out of which 25% posts are to be filled by direct recruitment, whereas, 75% posts are to be filled in by promotion. Petitioner falls in the promotion category. Since 75% posts are to be filled by way of promotion, so 16 posts would fall in the category of promotion quota. The reserved category as per the Government Order dated 23.07.2018 would be 4% and therefore, the posts in reserved category for physically challenged persons would come to 0.64%. Under the Government Order dated 28.08.2015 the State Government has prescribed that the principle of rounding off would not be applicable in the matters of reservation for physically challenged persons. The Government Order is reproduced hereunder:

2 शयसन कቚኔ ससंजयन मम कचतपय ऐसቚኔ पकरण आयቚኔ हसै जजनमम आरचकत ररचकयोረ ककी गणनय चनधिय቟ኋररत पचतशत कቚኔ आधियर पर करतቚኔ समय , गचणत कቚኔ 'रयउसंचडसंग आफ', कቚኔ जसदयन्त कቚኔ आधियर पर ररचकयोረ ककी गणनय ककी जयतर हसै। 'रयउसंचडसंग आफ' कቚኔ जसदयन्त कቚኔ अनमुसयर गणनय करनቚኔ पर आरचकत ቦኌቚኔणर ककी ररचकयय , आरचकत ቦኌቚኔणर हቚኔतमु अन म ुन्य पचतशत सቚኔ अजधिक हलो सकतर हसै, जलो चक आरकण चनयमोረ कቚኔ चवरुद हसै। शयसन दयरय चनधिय቟ኋररत आरकण पचतशत सቚኔ अजधिक आरकण पदयन चकयय जयनय चवजधिसम्मत नहर हसै।

उपयमु቟ኋक कቚኔ दृचरगत , सम्यकक चवचियरलोपरयसंत, यह चनण቟ኋय जलयय गयय हसै चक आरचकत ररचकयोረ ककी गणनय करतቚኔ समय गचणत कቚኔ रयउसंचडसंग आफ कቚኔ जसदयन्त कलो नहीሻ अपनययय जययቚኔगय, वरनक कቚኔवल पसूणय቟ኋकोረ कलो हर ससंजयन मम जलयय जययቚኔगय तथय चभ्ቐ (फसैक्शन) कलो नजरअसंदयज (इगलोर) चकयय जययቚኔगय। उदयहरणयथ቟ኋ यचद पचतशत कቚኔ आधियर पर आरचकत ररचकयोረ ककी ससंख्यय 1.5 आतर हसै, तलो 01 पद/ररचक आरचकत ककी जयएगर तथय इसर पकयर आरचकत ररचकयोረ ककी ससंख्यय 1.99 अगचणत हलोनቚኔ पर भर आरचकत पद /ररचक 01 हर हलोगर। अथय቟ኋतक, चभ्ቐ (फसैक्शन) कलो नजरअसंदयज (इगलोर) चकयय जययቚኔगय।

Thus, in view of the above, even if the petitioner is the only candidate in reserved category the quota comes to 0.64% posts which would not be rounded off as one (01), however, since the petitioner is in the category of physically challenged person, if the Government Order dated 03.02.2008 is taken to be still in force then the respondents could have considered to increase five times the number of percentage of posts reserved for physically challenged persons. In the matters of promotion vide clause 16 the Government Order provides thus:

पर चवचियर चकयय जयएगय। जहयसं सयमयन्य चवचियरण कቚኔ्ቔ मम चवकलयसंगोረ ककी उपयमुक ቦኌቚኔणर कቚኔ चवकलयसंग उम्मरदवयर पयय቟ኋ्቎ ससंख्यय मम उपलब्धि नहीሻ हलोतቚኔ, वहयसं चवचियरण कቚኔ्ቔ ररचकयोረ ककी ससंख्यय कय पयसंचि गमुनय बढय चदयय जयएगय और बढययቚኔ गयቚኔ चवचियरण कቚኔ्ቔ मम आनቚኔ वयलቚኔ चवकलयसंग उम्मरदवयरोረ पर चवचियर चकयय जयएगय। यचद बढययቚኔ गयቚኔ चवचियरण कቚኔ्ቔ मम भर उम्मरदवयर उपलब्धि नहीሻ हलो तलो यचद सम्भव हलो तलो आरकण ककी अदलय-बदलर ककी जय सकतर हसै तयचक पद कलो चवकलयसंगतय ककी अन्य ቦኌቚኔणर कቚኔ उम्मरदवयर दयरय भरय जय सकቚኔ। यचद आरकण दयरय पद कलो भरय जयनय सम्भव नहीሻ हलो तलो पद कलो चवकलयसंग व्यचक कቚኔ अचतररक चकसर अन्य व्यचक दयरय भरय जयए तथय आरकण कलो अगलቚኔ तरन भतቔኍ वषरसं तक अगनरत कर चदयय जयय जजसकቚኔ बयद वह समय्቎ हलो जयएगय।

(ख) अनमुपयमुकोረ कलो अस्वरकयर करतቚኔ हहए ज्यቚኔ्቗तय कቚኔ आधियर पर पदलो्ቐचत दयरय भरቚኔ जयनቚኔ वयलቚኔ पदोረ मम चवकलयसंगतय सቚኔ गस्त पय्ቔ उम्मरदवयरोረ कलो आरचकत ररचकयोረ पर पदलो्ቐचत दቚኔनቚኔ पर चवचियर चकयय जयएगय। यचद चवकलयसंगतय ककी उपयमुक ቦኌቚኔणर कय कलोई पय्ቔ उम्मरदवयर उपलब्धि नहीሻ हलोतय हसै तलो ररचक कलो चवकलयसंगतय ककी अन्य ቦኌቚኔणर जजसकቚኔ जलए पद कलो उपयमुक चचिशन्हत चकयቚኔ गयቚኔ होረ , कቚኔ सयथ अदलय-बदलर करकቚኔ भर आरकण दयरय पद कलो भरय जयनय सम्भव नहीሻ हसै तलो आरकण कलो अगलቚኔ तरन वषरसं तक अगनरत चकयय जयएगय जजसकቚኔ बयद यह समय्቎ हलो जयएगय।"

Thus, if five times posts are increased then definitely at least one post would go to the promotion category and the petitioner can of course be adjusted. In service jurisprudence, the law is well settled that there should not be any stagnation for an employee and more so in a case where State is the employer.

In such circumstances, if there is any enabling provision under a particular Government Order to increase the number of posts for physically challenged persons then there should be harmonious construction to the clause 16 of the Government Order dated 03.02.2008, the Government Order dated 23.07.2018 and the Government Order dated 28.08.2015.

In such above view of the matter, therefore, even though I do not find any manifest error in the impugned orders passed by the

authorities but at the same time I leave it open for the State Government to consider the claim of the petitioner in the light of Government Order dated 03.02.2008.

Petitioner accordingly shall be approaching the authority by making a representation within three weeks from today and the authority shall be disposing of the same on its own merits dealing with the relevant provisions of law and rules of reservation relating to the physically challenged persons, as expeditiously as possible, preferably within a further period of two months without being influenced by the orders impugned before this Court in this petition.

With the aforesaid observations and directions, this petition stands disposed of .
