Petitioner is a retired Class IV employee from Nagar Palika Parishad, Kasganj. His grievance is that though he has retired on 19.2.2021, but his retiral benefits i.e. payment of arrears of pension, gratuity amount, leave encashment have not been paid and huge amounts remain outstanding.

Learned counsel for the petitioner submits that in this regard petitioner has moved several representations and lastly on 10.11.2022, but the same is still pending consideration and purpose of filing this writ petition shall stand served if directions are issued to the respondents to release all the retiral dues within the time stipulated by this Court.

Sri Manoj Kumar Mishra, learned counsel for the respondent states that on account of cash crunch faced by the local body and also on account of diversion of all available resources towards handling of Covid-19 pandemic the entire retiral dues have not been paid. He, however, submits that the authority shall clear off all remaining amount within three months.

There is no serious objection to the proposal made on behalf of the respondents.

In the facts of the case, this writ petition sands disposed of directing the respondents to act as per their undertaking and ensure release of entire dues to petitioner within three months from the date of filing of certified copy of this order or else petitioner will also be entitled to interest at the rate of 8% per annum, on the withheld amount.
