Heard learned counsel for the petitioner and Shri Dev Prakash Mishra, learned counsel for the respondents.

The petitioner, in the present writ petition, alleges that he has been granted appointment on the post of Chaukidar on 15.7.2003 and continued to work till 31.10.2006, but salary for the aforesaid period was not paid to him.

Learned counsel for the petitioner submits that the petitioner has been regularly approaching respondent no.2 for redressal of the aforesaid grievance, but no heed has been paid. He further submits that in case a direction is issued for consideration of the claim for the payment of salary to respondent no.2, justice would be met.

Learned counsel for the petitioner further submits that there is no justification on the part of the respondents not to permit the petitioner to discharge his duty on the post of Chaukidar and not paying salary since 2003 to 31.10.2006. He lastly submits that act and action of the respondent is wholly illegal, arbitrary and discriminatory in nature.

On the other hand, learned counsel for the respondents submits that the petitioner has never been appointed in the institution, therefore there is no question of payment of salary to him. He next submits that in case his claim is pending consideration before the respondents, appropriate, reasoned and speaking order shall be passed within a reasonable period.

In view of the above, this writ petition is finally disposed of with a liberty to the petitioner to file a fresh comprehensive representation ventilating all his grievances before respondent

no.2 within two weeks from today and in case such a representation is filed within the aforesaid period, respondent no.2 shall consider and pass appropriate, reasoned and speaking order for disbursement of salary and his continuance within six weeks from the date of production of a certified copy of this order.
